C'est en effet à ce seul Peuplequ'ilappartient de décider comment il souhaite s'organiser sursonpropre territoire (art. 5). Une constitution ne saurait doncceux aqui elle s' appliquera.En instaurant un système destiné à organiser le pays, les règlesquise trouvent dans la constitution doivent réfleter le génied'unpeuple. Mal conçue, une constitution peut servire à couronnerunesituation injuste. C'est pourquoi quand un Peuple élaboreuneconstitution il doit tenir compte non seulement de sesexpériencenégative mais également de celle vécues par d'autrepeuples. Il s'agit alors de concevoir la meilleure organisationpossible del'Etat qui permette de garantir la justice et l'ordresur leterritoire.Il est à relever que le peuple doit également faire des règlessurla procédure.
